The Bill (Reg. No. 1139) proposed to revoke the effective Law "On the Cabinet of Ministers of Ukraine", the regulations of which fail to comply with the statements of the Constitution of Ukraine.
The discussion regarding the said Bill was held at the meeting.
Inter alia, Yuriy Kliuchkovsky, the Committee Vice-Chairman, stated that imperfection of the Law "On the Cabinet of Ministers of Ukraine" is not the reason for declaring the said Law invalid, without simultaneous adoption of a new Law on the said subject. He believes that method, envisaged by the Bill, deprives the supreme executive body of a due legislative foundation, which can considerably reduce efficiency of not only the Cabinet of Ministers of Ukraine, but also the entire system of executive bodies.
Therefore, the Committee is of the opinion that the defects, indicated by the subject of legislative initiative, are to be eliminated either by introduction of comprehensive and coordinated amendments to the effective Law "On the Cabinet of Ministers of Ukraine" (even, possibly, in the form of a new version of the Law), or by adoption of a new Law on the said subject.
The Committee members believe that elimination of the defects by means of revoking of the effective Law will create essential problems in the field of legal regulation of activity of Ukrainian executive bodies.
The People´s Deputies also emphasized that on 10 January 2008, the President of Ukraine already submitted new Draft Version of the Law "On the Cabinet of Ministers of Ukraine" for parliamentary consideration. Therefore, the meeting participants also called for taking this Bill into consideration whilst correcting the Presidential one.
